InkSmart.com is operated by Indys Marketing Ltd, based in New Zealand. We sell dog and cat T-shirts printed to order.

This policy explains how we collect, use, store and share personal information when you visit our website, place an order or contact us.

1. Who is responsible for your information?

Indys Marketing Ltd is responsible for the personal information we collect through InkSmart.com. Where applicable privacy law uses the term “data controller”, we are the controller for this information.

You can contact our Privacy Officer at:

Email: hello@inksmart.com
Post: Indys Marketing Ltd — InkSmart.com

2. Information we collect

Depending on how you interact with us, we collect:

  • Contact information: your name, email address and phone number.

  • Order information: billing and delivery addresses, products purchased, delivery instructions and order history.

  • Payment information: payment status, transaction references and information needed to manage payments or refunds.

  • Account information: login and account details if you create an account.

  • Customer support information: messages, photographs and other details you provide when asking for help.

  • Technical information: your IP address, browser and device information, and security or server logs.

  • Marketing preferences: your subscription choices if you sign up for marketing when that service becomes available.

We usually collect information directly from you. We may also receive payment confirmations from payment providers and fulfilment or delivery updates from Printify, print providers and carriers.

If you give us another person’s details, such as a gift recipient’s address, please make sure you are authorised to provide them and make this policy available to that person.

3. Why we use your information

We use personal information to:

  • Accept and manage orders.

  • Process payments and refunds.

  • Arrange printing, shipping and delivery tracking.

  • Send order confirmations and service updates.

  • Answer questions and resolve complaints.

  • Manage customer accounts.

  • Detect fraud and protect our website.

  • Maintain accounting and business records.

  • Meet legal obligations and establish or defend legal claims.

  • Send marketing emails where you have subscribed and the service is available.

Providing information is generally your choice. However, we cannot process an order without the contact, payment and delivery details needed to complete it. Required fields are identified when you provide information.

4. Payments through WooPayments

We use WooPayments, which is built in partnership with Stripe, to process payments.

Information needed to process and protect your payment is shared with the relevant payment providers. This may include billing information, transaction details and technical information used to detect fraud.

Full payment card details are handled by the payment providers rather than stored in our website’s order records. We retain the transaction information needed to manage orders, refunds and accounts.

Please do not send card numbers or security codes by email or through our contact form.

Further information is available in:

5. Printing and delivery through Printify

We use Printify and its print providers to produce and fulfil orders.

We share information needed to print and deliver your products, including your name, delivery address, order details and contact details where needed for delivery.

Shipping and delivery companies also receive information necessary to transport your parcel and provide delivery updates.

Read Printify’s Privacy Policy for information about its practices.

6. Other organisations that receive information

We may share relevant information with:

  • Website hosting, security and technical support providers.

  • Payment and fraud prevention providers.

  • Printify, print providers and delivery companies.

  • Providers that send essential order and service emails.

  • Professional advisers, such as accountants or legal advisers, where necessary.

  • Authorities or other parties where disclosure is required or permitted by law.

We limit the information shared to what is reasonably needed for the relevant purpose.

7. Overseas processing and storage

InkSmart.com is operated from New Zealand, but some service providers operate internationally.

Your information may be processed or stored in New Zealand, the United States and other countries where our providers, print partners or delivery companies operate. The locations involved can depend on the service used and where your order is produced and delivered.

Overseas countries may have privacy laws that differ from those in your country. Information held overseas may also be subject to lawful requests from local courts or authorities.

Where applicable law requires safeguards for an international transfer, we must ensure an appropriate transfer mechanism or lawful exception applies. This may involve recognised adequacy arrangements or approved contractual protections.

Contact hello@inksmart.com to ask about the providers and safeguards relevant to your information.

8. Cookies and similar technologies

Our website uses cookies and similar technologies to support functions such as the shopping cart, checkout, account login and security.

Some providers involved in payments or embedded services may also use cookies or similar technologies under their own notices.

You can manage or delete cookies through your browser settings. Blocking essential cookies may prevent parts of the shop from working properly.

Google Analytics is not currently connected to InkSmart.com. We intend to introduce it to help us understand website use. Before enabling it, we will update this policy with details of the information collected and the controls available, and implement any consent or other measures required by applicable law.

9. Email marketing and Kit

Kit, formerly ConvertKit, is planned for our newsletter and promotional email service but is not currently active on InkSmart.com.

When introduced, it will be used to manage voluntary subscriptions and send offers and product news. We will update this policy and explain what information is collected through the signup process before activating it.

Buying from us does not automatically subscribe you to promotional emails.

Once marketing emails are available, you will be able to unsubscribe through the link in each email or by contacting us. Essential order and service messages may still be sent after you unsubscribe.

10. Legal grounds for using information

Where UK or European data protection law applies, we rely on the following grounds:

  • Contract: to take steps you request before a purchase and to fulfil orders.

  • Legal obligation: to keep required records and meet other legal duties.

  • Legitimate interests: to provide customer support, protect our business against fraud, maintain security and manage legal claims, where these interests are not overridden by your rights.

  • Consent: where required for optional marketing, cookies or other optional activities.

You may withdraw consent at any time by contacting us or using the relevant unsubscribe or privacy control. Withdrawal does not affect processing that was lawful before you withdrew consent.

11. How long we keep information

We keep personal information for as long as reasonably necessary for the purpose it was collected.

Retention depends on factors including:

  • Whether an order, refund or enquiry is still being handled.

  • Applicable tax and accounting recordkeeping requirements.

  • Whether information is needed to resolve a dispute or legal claim.

  • Whether an account remains in use.

  • The security purpose and appropriate lifespan of technical logs.

We may retain a limited record of an unsubscribe request to ensure we respect your marketing preferences.

When information is no longer required, we take reasonable steps to delete it securely or remove identifying details. Copies in backups may remain until those backups are replaced through their normal retention cycle.

12. Protecting your information

We use reasonable technical and organisational safeguards to protect personal information against loss, misuse and unauthorised access, alteration or disclosure.

Access is limited to people and providers who need information for their work.

No website or internet transmission is completely secure.

13. Your privacy rights

You can contact us to ask for access to the personal information we hold about you or request correction of inaccurate information.

Depending on your location and the law that applies, you may also have rights to:

  • Request deletion of information.

  • Restrict certain uses of information.

  • Object to certain processing.

  • Receive certain information in a portable format.

  • Withdraw consent.

  • Complain to a privacy regulator.

These rights are subject to legal conditions and exceptions. For example, we may need to retain records required by tax law.

Where you have a right to object to processing based on legitimate interests, you can exercise it by emailing hello@inksmart.com. You can object to direct marketing at any time.

We may need to verify your identity before responding. We will respond within the timeframe required by applicable law and explain any lawful reason why we cannot fulfil a request.
